This page explains how Attensi receives reports, restricts content and provides statements of reasons and redress under the EU Digital Services Act (Regulation (EU) 2022/2065) and the UK Online Safety Act 2023. Certain obligations depend on service classification, feature design and any applicable exemptions.
1 Role and Contacts
1.1 In respect of user content stored at the request of a user, Attensi may act as a provider of hosting services. Where a feature disseminates user content to the public, obligations applicable to online platforms may apply. Private or limited link sharing may not constitute dissemination to the public. Attensi applies the measures described below where legally applicable and may apply them voluntarily in other cases.
1.2 The single point of contact for Member State authorities, the European Commission and the European Board for Digital Services is legal@attensi.com. Communications may be made in English or Norwegian. The single point of contact for recipients of the service is legal@attensi.com. These points of contact support electronic communication.
2 Notice and Action
2.1 Notices may be submitted to legal@attensi.com. Each notice should: (a) identify the precise electronic location of the information; (b) explain why the information is considered to be illegal; (c) provide the name and email address of the person submitting the notice, except where the law permits anonymity; and (d) include a statement confirming the submitter’s good-faith belief that the notice is accurate and complete.
2.2 Attensi will acknowledge receipt of each notice electronically, assess it in a timely, diligent, objective and non-arbitrary manner, and notify the person who submitted it of its decision and of the available redress where required. A sufficiently precise and adequately substantiated notice may give Attensi knowledge for the purposes of the applicable hosting rules.
3 Statement of Reasons
3.1 Where required by Article 17 of the Digital Services Act, Attensi will provide the affected recipient with a clear statement of reasons where it: (a) removes, disables access to, demotes or otherwise restricts the visibility of information; (b) suspends or terminates monetary payments; (c) restricts the provision of the Service; or (d) suspends or terminates an Account.
3.2 Each statement of reasons will set out: (a) the measure taken and its territorial scope or duration; (b) the facts and circumstances relied on, including whether the decision was taken in response to a notice or on the basis of an own-initiative investigation; (c) whether automated means were used; (d) where applicable, the legal ground relied on and an explanation of why the information is considered illegal; (e) the contractual ground relied on, including the relevant provision; and (f) the internal complaint-handling, out-of-court dispute settlement and judicial redress options available.
4 Complaints and Out-of-Court Dispute Settlement
4.1 Where Article 20 of the Digital Services Act applies, an affected recipient may lodge a complaint through legal@attensi.com for a period of at least six months from the date of the decision. Complaints will be handled by appropriately qualified staff in a timely, non-discriminatory and diligent manner, and not solely on the basis of automated means. Attensi will reverse any unjustified decision without undue delay.
4.2 Where Article 21 of the Digital Services Act applies, an eligible recipient may select a certified out-of-court dispute settlement body. Attensi will engage with that body in good faith as required, but the body’s decision shall not be binding. The right to bring proceedings before the courts remains unaffected.
5 Misuse, Transparency Reporting and Recommender Systems
5.1 Where Article 23 of the Digital Services Act applies, Attensi may, after issuing a prior warning, suspend recipients who frequently provide manifestly illegal content and persons who frequently submit notices or complaints that are manifestly unfounded. In doing so, Attensi will take into account the absolute numbers and proportion of such items, their gravity and consequences, and the apparent intention of the person concerned.
5.2 Attensi will publish on its legal pages any annual transparency report required by Article 15 or Article 24 of the Digital Services Act. Any such report will include the required information on orders from authorities, notices, content moderation, the use of automated tools, complaints, out-of-court disputes and suspensions, subject to applicable exemptions and reporting periods.
5.3 QuizRace does not currently use a recommender system to rank or personalise user content. If this changes and Article 27 of the Digital Services Act applies, Attensi will set out in plain and intelligible language the main parameters used, their relative importance and the controls available to users.
6 United Kingdom Online Safety Act 2023
6.1 Where QuizRace constitutes a regulated user-to-user service with links to the United Kingdom, Attensi will carry out, and keep up to date, an illegal content risk assessment and a children’s access assessment. If children are able to access the service, Attensi will also carry out, and keep up to date, a children’s risk assessment.
6.2 Attensi operates proportionate systems and processes designed to prevent users from encountering priority illegal content, to minimise the length of time for which any other illegal content is present and to swiftly take down illegal content once it becomes aware of it, in each case as required by law.
6.3 Users may report content and complain about decisions by contacting legal@attensi.com. The notice and action process described in clause 2 and the complaints process described in clause 4 apply to such reports and complaints where relevant.
6.4 Attensi maintains records of its risk assessments and of the measures, decisions, complaints and changes required to be recorded under the Online Safety Act 2023, and provides information to Ofcom where legally required.
6.5 The separate duties relating to terms of service that would apply if QuizRace were designated as a Category 1 service are acknowledged in clause 9.4 of the QuizRace Terms of Use.
